What the law covers
Florida Statute Section 720.304 sets out statutory protections for parcel owners in homeowners' associations (HOAs) and community development districts. The law covers access to common areas and recreational facilities for peaceful assembly and guest speakers, regulations regarding flag displays and flagpoles, prohibitions against Strategic Lawsuits Against Public Participation (SLAPP suits), rules for installing disability access ramps, and the right to post security service signs.
Key requirements and limits
Section 720.304 outlines specific rules and operational limits:
- Assembly and Public Speakers: Common areas and recreational facilities serving an HOA must be available to parcel owners and their invited guests for their intended use. Operating entities cannot unreasonably restrict an owner's right to peaceably assemble or invite public officers or political candidates to speak in common areas.
- Display of Flags: Homeowners may display up to two portable, removable flags (not larger than 4 1/2 feet by 6 feet) in a respectful manner regardless of HOA prohibitions. Permitted flags are the United States flag, the Florida state flag, U.S. Armed Forces flags (Army, Navy, Air Force, Marine Corps, Space Force, Coast Guard), POW-MIA flags, and first responder flags.
- Freestanding Flagpoles: Homeowners may erect one freestanding flagpole up to 20 feet high on their real property, provided it does not obstruct intersection sightlines or stand within an easement. The pole may fly one official U.S. flag (up to 4 1/2 feet by 6 feet) and one additional permitted flag of equal or smaller size. Flagpoles must comply with governmental building codes, zoning setbacks, ordinances, and locational criteria in governing documents.
- SLAPP Suits Prohibited: Governmental entities, business entities, and individuals cannot file meritless lawsuits against parcel owners solely for exercising their rights to petition or address governmental entities on HOA matters. HOAs cannot spend association funds to prosecute a SLAPP suit.
- Access Ramps: Parcel owners may construct an access ramp if a resident or occupant has a medical necessity or disability requiring one for entry and exit. The ramp must be reasonably sized, unobtrusive, and designed to blend aesthetically where practicable. Plans and a physician affidavit (or s. 320.0848 certification) must be submitted to the HOA in advance.
- Security Signs: Homeowners may display a sign of reasonable size provided by a security services contractor within 10 feet of any entrance to the home.
Please note that the association's governing documents and later amendments may also apply.
Practical checklist for homeowners
Here are neutral, practical steps homeowners can take when navigating these statutory provisions:
- Read your association's governing documents for setback, locational, or architectural review procedures.
- Keep copies of all written notices, ramp design plans, medical affidavits, and correspondence sent to or received from the association.
- Check local county or municipal ordinances for applicable building codes, zoning setbacks, noise rules, or lighting limits before installing flagpoles or structures.
- Check the official statute text for updates to Florida HOA laws.
